TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Yener Alacayir ("we," "us," or "our") governing your access to and use of the Bookworm mobile application and any related services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.

If you are a school or educational institution entering into a license agreement with us, these Terms govern that relationship. Students access the Service solely under the authority and responsibility of their school.

2. ELIGIBILITY AND MINOR USERS

2.1 Age Requirement

The Service is designed for use by primary school students aged 7-12 ("Students") under institutional supervision. Individuals under the age of 18 do not have legal capacity to enter into a binding agreement under Turkish law.

2.2 School as Contracting Party

Students are not direct parties to these Terms. The contracting party is the licensed school or educational institution ("School") that has entered into a license agreement with us. By activating student accounts, the School:

  • Confirms it has obtained all necessary parental or guardian consents
  • Accepts full responsibility for Students' use of the Service
  • Agrees to supervise Students' access in accordance with these Terms

2.3 Parent and Guardian Acknowledgment

Parents or guardians whose children use the Service do so through the School's license. Any inquiries regarding their child's data or account must be directed to the School administrator or to us at alacayiryener@gmail.com.

3. SCHOOL LICENSE MODEL

3.1 License Grant

Subject to these Terms and any executed license agreement, we grant the School a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • Access and use the Service for educational purposes during the license term
  • Permit enrolled Students to use the Service under the School's supervision

3.2 License Restrictions

The School may not:

  • Transfer, sublicense, sell, or assign the license to any third party
  • Use the Service for purposes outside of student education
  • Allow access to individuals not enrolled in the School's active license
  • Attempt to circumvent any technical limitations of the Service

3.3 Account Provisioning

Student accounts are created exclusively by us upon the School's request. Self-registration is not available. Each Student account is tied to the School's license and cannot be transferred between institutions.

3.4 License Term and Renewal

The license is valid for the duration specified in the executed license agreement. Upon expiration, all Student accounts associated with the School will be deactivated. Student data will be retained for 30 days following license termination, after which it will be permanently deleted.

4. USER ACCOUNTS

4.1 Account Credentials

Students log in using their Turkish National ID number (TC Kimlik No), which is used solely to generate a unique internal account identifier. The TC Kimlik No is never stored on our servers.

4.2 Account Security

The School is responsible for:

  • Ensuring credentials are distributed securely to Students
  • Promptly notifying us of any unauthorized account access at alacayiryener@gmail.com
  • Maintaining the confidentiality of login credentials

4.3 Account Accuracy

All display names and profile information associated with Student accounts must be accurate. We reserve the right to suspend accounts containing false or misleading information.

5. ACCEPTABLE USE POLICY

5.1 Permitted Uses

Users may use the Service solely to:

  • Generate and read AI-powered English language stories
  • Complete comprehension quizzes and vocabulary exercises
  • Track reading progress and educational achievements
  • Participate in school-level leaderboards

5.2 Prohibited Conduct

The following are strictly prohibited:

  • Unauthorized access: attempting to access another user's account or any non-public portion of the Service
  • System abuse: submitting excessive requests, automated scripts, or actions intended to degrade Service performance
  • Harmful content: entering story prompts that include personal information, hate speech, violence, sexually explicit material, or any content inappropriate for children
  • Reverse engineering: decompiling, disassembling, or attempting to derive source code from the Service
  • Commercial exploitation: using any part of the Service or its generated content for commercial purposes outside the scope of the license
  • Impersonation: misrepresenting identity or affiliation
  • Policy violation: any use that violates applicable laws, regulations, or third-party rights

5.3 Enforcement

We reserve the right to suspend or terminate access for any user or School found in violation of this Acceptable Use Policy, without prior notice and without liability.

6. AI-GENERATED CONTENT

6.1 Nature of AI Content

The Service uses artificial intelligence technologies to generate stories, images, and audio ("AI Content"). Specifically:

  • Story text is generated by Google LLC's Gemini API
  • Story illustrations are generated by Black Forest Labs' FLUX Schnell model via Replicate
  • Audio narration is produced by Inworld AI's text-to-speech service

6.2 No Guarantee of Accuracy or Appropriateness

AI-generated content is produced algorithmically and may occasionally contain inaccuracies, grammatical errors, or culturally inconsistent elements. We do not guarantee that any generated story will be factually accurate, that AI Content will always align perfectly with the entered topic, or that image generation will always accurately represent the story.

We continuously monitor output quality and apply content filters appropriate for the target age group, but cannot guarantee 100% accuracy or appropriateness in every case.

6.3 User Prompts

When a user enters a story topic or theme ("User Prompt"), that input is transmitted to third-party AI service providers for processing. Users must not include personal information, names of real individuals, or sensitive data in User Prompts. We are not responsible for the content of User Prompts.

6.4 Intellectual Property of AI Content

AI-generated stories, images, and audio produced through the Service are provided for educational use within the application. You may not reproduce, distribute, or commercialize AI Content outside the Service without our prior written consent. The intellectual property status of AI-generated content under Turkish and international law is evolving; we make no representations regarding ownership rights in AI Content.

6.5 Reporting Inappropriate Content

If a Student or School encounters AI Content that appears inappropriate, inaccurate, or harmful, please report it immediately to alacayiryener@gmail.com with the subject line "Content Report." We will review and, if necessary, remove the content within 5 business days.

7. INTELLECTUAL PROPERTY

7.1 Our Property

The Service, including its design, code, branding, logo, interface, educational structure, and all non-AI-generated content, is owned exclusively by Yener Alacayir and protected by applicable Turkish and international intellectual property laws. All rights are reserved.

"Bookworm" and associated marks are proprietary. Nothing in these Terms grants you any right to use our trademarks, trade names, or logos.

7.2 Your Content

User Prompts submitted by Students remain the property of the School or Student. By submitting User Prompts, you grant us a limited, royalty-free license to process them solely to deliver the Service. We do not use User Prompts to train AI models or for any purpose other than story generation.

7.3 Feedback

If you provide suggestions, feedback, or ideas regarding the Service ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use such Feedback without restriction or compensation.

8. THIRD-PARTY SERVICES

8.1 Service Providers

The Service relies on the following third-party providers:

  • Google LLC (Gemini API): story text generation
  • Replicate / Black Forest Labs (FLUX Schnell): story image generation
  • Inworld AI: audio narration (TTS)
  • Supabase Inc.: database and infrastructure

8.2 No Liability for Third-Party Services

We are not responsible for the availability, accuracy, or actions of third-party providers. Interruptions to AI services, infrastructure downtime, or changes in third-party policies may affect the Service. We will endeavor to minimize disruption but cannot guarantee uninterrupted availability.

8.3 Third-Party Terms

Use of the Service is also subject to the applicable terms and policies of the third-party providers listed above. We are not a party to agreements between users and those providers.

9. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

WE SPECIFICALLY DISCLAIM:

  • Any warranty that the Service will be error-free, uninterrupted, or secure
  • Any warranty regarding the accuracy, completeness, or educational suitability of AI-generated content
  • Any warranty that the Service will meet your specific educational requirements
  • Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement

Nothing in these Terms excludes warranties that cannot be excluded under Turkish consumer protection law.

10. LIMITATION OF LIABILITY

10.1 Exclusion of Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of student data, educational disruption or learning outcome failures, loss of BW Points, stories, or progress records, and damages arising from third-party service failures.

10.2 Cap on Liability

Our total liability to any School for any claim arising from or related to these Terms shall not exceed the total license fees paid by that School to us in the 12 months preceding the claim.

10.3 Essential Basis

The limitations in this Section reflect a reasonable allocation of risk and are an essential element of the basis of the bargain between you and us. We would not provide the Service without these limitations.

11. INDEMNIFICATION

The School agrees to indemnify, defend, and hold harmless Yener Alacayir from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • The School's or its Students' violation of these Terms
  • User Prompts submitted through the Service
  • The School's failure to obtain required parental consents
  • Any third-party claim related to the School's use of the Service

12. FORCE MAJEURE

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government action, internet or infrastructure failures, pandemic, or failures of third-party service providers.

13. TERMINATION

13.1 Termination by School

The School may terminate its license agreement in accordance with the terms of that agreement. Upon termination:

  • All Student accounts will be deactivated within 7 days
  • Student data will be retained for 30 days, then permanently deleted
  • No refunds will be issued for the unused portion of a prepaid license term, unless otherwise agreed in writing

13.2 Termination by Us

We may suspend or terminate access immediately and without notice if:

  • The School or any Student violates these Terms
  • We are required to do so by law or regulatory authority
  • Continuing the Service poses a security risk to other users

13.3 Effect of Termination

Upon termination, all licenses granted under these Terms cease immediately. Sections 6, 7, 9, 10, 11, and 15 survive termination.

14. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. When we make material changes:

  • We will update the "Last updated" date at the top of this document
  • We will notify the School by email at least 14 days before the changes take effect
  • Continued use of the Service after the effective date constitutes acceptance of the revised Terms

If you do not agree to the modified Terms, you must discontinue use of the Service and notify us to terminate your license.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

These Terms are governed by the laws of the Republic of Turkey, including but not limited to Law No. 6698 (KVKK - Personal Data Protection Law), Law No. 6563 (Electronic Commerce Law), the Turkish Code of Obligations (Law No. 6098), and the Turkish Commercial Code (Law No. 6102).

15.2 Jurisdiction

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of Erzincan, Turkey.

15.3 Informal Resolution

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute informally by contacting alacayiryener@gmail.com. We will make reasonable efforts to resolve the dispute within 30 days of receipt.

16. GENERAL PROVISIONS

16.1 Entire Agreement

These Terms, together with any executed license agreement and our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16.4 Assignment

The School may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.

16.5 Language

These Terms are written in English and Turkish. In the event of any conflict between the English version and the Turkish version, the English version shall prevail.
